Terms & Conditions

These Terms govern your relationship with the operator of the website available at coinpoker-aussie.com in connection with your use of the Coin Poker review and related services provided under the project instance "Coin Poker" (the "Service"). By accessing or using the Service you agree to be bound by these Terms. If you do not agree, you must not use the Service. These Terms are effective as of 1 January 2026.

Definitions

For the purposes of these Terms, the following definitions apply:

  • "Coin Poker" means the specific project instance and content set relating to Coin Poker made available through the domain coinpoker-aussie.com and any associated subdomains.
  • "Website" or "Site" means the online portal accessible at https://coinpoker-aussie.com, including all pages, content, and services associated with Coin Poker.
  • "Operator" means the private offshore entity or entities responsible for operating and maintaining the Website and the Coin Poker project instance. The Operator may act through, or in commercial association with, entities such as Transferencia Processing Ltd and/or platform licensors such as Cyberluck Curaçao N.V. under Curaçao eGaming sublicense no. 1668/JAZ, as may be reflected from time to time in the Website footer or legal notices.
  • "User" or "you" means any natural person who accesses, browses, or otherwise uses the Website or Service, regardless of whether that person registers an account with any third-party gambling or poker platform referenced on or linked from the Website.
  • "Player" means a User who, in addition to using the Website, participates in real-money or virtual-money gambling, poker, or wagering activities with third-party operators or platforms (including but not limited to those holding Curaçao license 1668/JAZ) that may be reviewed, described, or linked from the Website. The Player's contractual relationship for gambling is always with the relevant gambling operator, not with Coin Poker or the Website Operator.
  • "Account" means any user profile, login, or registration that may be created on the Website (if and when such functionality is offered) to access additional features such as newsletters, saved reviews, or community discussion, and does not refer to any gambling or poker account held with third-party operators.
  • "Bet" or "Wager" means any stake, bet, or similar risk-bearing transaction in money, crypto-assets, or any other thing of value placed by a Player with a third-party gambling or poker operator, including but not limited to operators offering services under Curaçao license 1668/JAZ or crypto-poker protocols such as "Mental Poker," and does not refer to any transaction with the Operator of Coin Poker, which does not itself accept bets.
  • "Bonus" means any promotional offer, including free bets, matched deposits, free spins, rakeback, or other incentives, which may be advertised or described on the Website but is offered and administered by a third-party operator under its own terms and conditions, unless explicitly stated otherwise.
  • "Content" means all information, data, text, graphics, logos, images, videos, software, code, reviews, ratings, and other materials displayed on or made available through the Website, including any reviews, analyses, or educational articles about Coin Poker, crypto-gambling, or related topics.
  • "Service" means the informational, comparative, and review services provided via the Website in relation to Coin Poker and other gambling-related offerings, including access to Content, tools, and links to third-party sites.
  • "Third-Party Operator" means any independent gambling, poker, casino, or wagering service provider (including offshore and crypto-based services) that is reviewed, mentioned, rated, or linked from the Website and that holds and operates under its own license(s), such as the Curaçao eGaming sublicense no. 1668/JAZ issued by Cyberluck Curaçao N.V.
  • "Australian Law" means all applicable laws of the Commonwealth of Australia and its States and Territories, including without limitation the Interactive Gambling Act 2001 (Cth) ("IGA") and any directions, policies, or enforcement actions of the Australian Communications and Media Authority ("ACMA").
  • "Prohibited Jurisdiction" means any jurisdiction where your use of the Website or participation in online gambling, including online poker, is restricted or prohibited by law, including Australia to the extent that relevant services are prohibited under the IGA.

Account Registration

The Website primarily provides informational and review services and may, from time to time, allow Users to create a Website Account (for example, to comment on reviews, subscribe to newsletters, or personalise content). Any such Account is distinct from accounts you may open with Third-Party Operators.

Eligibility and Age Requirements

  • Minimum age: You must be at least 18 years old, or the legal age of majority in your place of residence (whichever is higher), to use the Website and any Service that relates to gambling, and to follow any outbound links to Third-Party Operators.
  • Australian context: Under Australian Law, it is not illegal for an individual Australian resident to participate in offshore online gambling; however, it is prohibited for unlicensed operators to offer certain interactive gambling services (including online poker) to persons in Australia. The Operator does not itself provide gambling services and does not encourage or facilitate any breach of the IGA.
  • Self-certification: By using the Website, you certify that:
    • you are of legal gambling age in your jurisdiction;
    • you are not accessing the Website from a Prohibited Jurisdiction where such access is unlawful; and
    • you will not use the Website in contravention of any applicable law.

Account Creation Process

  • Registration: If the Website offers Account registration, you may be required to provide:
    • your full name;
    • a valid email address;
    • a chosen username and password; and
    • any other information reasonably requested by the Operator for security or compliance purposes.
  • Email verification: You may be required to verify your email address by clicking on a link sent to the address you provide. Your Account may remain inactive until verification is completed.
  • KYC documents: The Operator does not typically perform customer due diligence or KYC checks for Website Accounts only. However, to the extent that legal, regulatory, or fraud-prevention obligations arise (for example, if the Website later adds financial features), the Operator reserves the right to request identity documents, proof of age, and other information and to suspend or close Accounts where verification is not completed.
  • Third-party accounts: Any registration with a Third-Party Operator, including Coin Poker or other platforms holding license no. 1668/JAZ, is subject exclusively to that operator's account-opening, KYC, and verification procedures. The Operator of Coin Poker is not a party to and has no control over such procedures.

User Obligations

  • Accuracy of data: You must ensure that all information you provide to the Operator (including during registration, in support requests, and in any content submissions) is true, accurate, complete, and kept up to date.
  • Password security: You are solely responsible for maintaining the confidentiality and security of your login credentials. You must:
    • choose a strong and unique password;
    • not share your password with any third party; and
    • notify the Operator immediately at [email protected] if you suspect any unauthorised access to your Account.
  • Single account: Unless explicitly permitted, you may hold only one Account per person on the Website. The Operator may close duplicate Accounts and, where appropriate, restrict access.
  • Compliance: You agree to comply with these Terms, any additional policies referenced herein (including the Privacy & Data Protection section), and all applicable laws, including Australian Law when accessing the Website from Australia.

Betting & Gameplay Rules

The Website does not itself offer real-money betting, poker tables, or casino games. Instead, Coin Poker provides reviews, analysis, and links to Third-Party Operators, including offshore and crypto-based platforms such as Coin Poker. Accordingly, any Bet, Wager, or gameplay is conducted directly with those Third-Party Operators under their rules and not under these Terms.

Placing Bets and Gameplay

  • Third-party rules apply: All rules relating to:
    • minimum and maximum bet sizes;
    • game types (e.g., cash games, tournaments, sit-and-go, casino side games);
    • table limits and rake structures; and
    • bonus buy-ins and promotional mechanics
    are determined solely by the relevant Third-Party Operator and are set out in that operator's terms and game rules.
  • No bets with Operator: The Operator of Coin Poker:
    • does not accept or settle Bets or Wagers;
    • does not hold Player funds or gaming balances; and
    • is not responsible for the outcome of any Bet or game conducted on a Third-Party Operator's site or app.

Cancellation and Modification of Bets

  • Operator non-involvement: Requests to cancel or modify any Bet or Wager, or to reverse gameplay outcomes, must be directed to the relevant Third-Party Operator. The Website has no technical or contractual capacity to alter or cancel bets placed elsewhere.
  • Information only: Any information published on the Website regarding bet cancellations, cash-out features, or dispute processes is provided for informational purposes only. Such information may be incomplete or out of date and does not override the Third-Party Operator's official rules and procedures.

Rules of Conduct in Live Environments and Chats

  • Website interactions: Where the Website offers user-generated content features (e.g., comments on reviews, community forums):
    • You must not post content that is abusive, defamatory, threatening, obscene, racist, sexist, or otherwise offensive.
    • You must not engage in harassment, doxxing, spamming, or the promotion of illegal activities.
    • You must not promote or facilitate fraud, money laundering, or any activity that could reasonably be viewed as circumventing Australian Law, including the IGA.
  • Third-party chats: Conduct in live casino chats, poker tables, or messaging features hosted by Third-Party Operators is governed by those operators' own rules. However, you should in all cases refrain from:
    • cheating, collusion, or use of bots or prohibited software;
    • chip dumping, soft-playing, or other integrity-breaching behaviours;
    • insulting, harassing, or threatening other players or staff.
  • Fraud and misuse: The Operator may, at its discretion, suspend or terminate your Website Account if it reasonably suspects that your use of the Website is connected with:
    • fraudulent activity on Third-Party Operator sites;
    • attempts to mislead other Users about the legality, safety, or financial standing of offshore operators; or
    • abuse of review tools or ratings to manipulate public perception for unlawful purposes.

Bonus Terms

The Website may describe or display Bonuses, promotional codes, or special offers provided by Third-Party Operators, including those licensed in Curaçao under sublicense 1668/JAZ. The Operator does not itself issue, fund, or administer such Bonuses unless expressly stated. All Bonus terms are illustrative only and subject to the Third-Party Operator's official rules.

Bonus Activation and Wagering Requirements

  • Source of bonuses: Any:
    • deposit match;
    • free tickets or tournament entries;
    • rakeback or cashback;
    • no-deposit free play; or
    • VIP or loyalty rewards
    presented on Coin Poker are offered by Third-Party Operators and are subject to change or withdrawal without notice.
  • Activation conditions: Common conditions for activating Bonuses (for information only) may include:
    • minimum qualifying deposit or wager;
    • use of a specific promo code or link;
    • time-limited availability of the offer; and
    • restrictions for residents of certain countries, including Australia.
  • Wagering requirements: Bonuses usually:
    • must be wagered a stated number of times (e.g., 20x, 40x) within a specified time;
    • may contribute differently depending on the game type (e.g., poker vs. casino slots); and
    • may cap maximum winnings or withdrawable amounts.
    The precise requirements are determined by the Third-Party Operator and prevail over any summary published on the Website.

Prohibited Games, Actions, and Abuse

  • Prohibited play: Third-Party Operators may prohibit certain strategies deemed as Bonus abuse, such as:
    • low-risk or risk-free betting patterns;
    • collusive play to unlock bonuses;
    • multi-accounting; or
    • using VPNs or false locations to circumvent territorial restrictions (including Australian restrictions under the IGA).
  • Responsibility: You are solely responsible for:
    • reading and understanding the applicable Bonus terms on the Third-Party Operator's website; and
    • ensuring that your actions do not constitute Bonus abuse, fraud, or breach of law.

Combining Promotions

  • Non-cumulative offers: Many Bonuses cannot be combined with other promotions or may have specific order-of-use rules. Any statements on the Website regarding combinability of promotions are informational only.
  • Australian context: Where Bonuses are restricted or prohibited for Australian residents by the Third-Party Operator or by Australian Law, those restrictions override any promotional content appearing on Coin Poker.

Payments & Withdrawals

The Operator of Coin Poker does not process gambling deposits or withdrawals and does not hold Player funds. Any financial transaction relating to gambling, poker, or wagering is conducted directly between you and the relevant Third-Party Operator, which may include entities operating under Curaçao sublicense 1668/JAZ or other offshore/crypto structures.

Deposit and Withdrawal Methods

  • Typical methods (for information only): Third-Party Operators referenced or reviewed on the Website may accept:
    • credit and debit cards;
    • e-wallets;
    • bank transfers;
    • crypto-assets (e.g., BTC, ETH, USDT, and other tokens); and
    • other local or international payment solutions.
  • No custody by Operator: The Operator:
    • does not receive, store, or remit any of your gambling funds;
    • does not control Third-Party Operators' wallets, bank accounts, or payment processors; and
    • cannot expedite, reverse, or guarantee any deposit or withdrawal.

Limits, Fees, and Processing Times

  • Variable conditions: Deposit and withdrawal:
    • limits (minimum and maximum);
    • fees or charges (including network fees for crypto-transactions); and
    • processing and settlement times
    are determined exclusively by the relevant Third-Party Operator and its payment providers.
  • On-chain transparency (crypto-gambling context): Some crypto-operators may provide public wallet addresses and on-chain balances to indicate solvency. Such data:
    • is not audited financial information;
    • does not constitute a legal guarantee of payment; and
    • does not involve any liability of the Operator of this Website.

Refunds of Bets and Bonuses

  • No refunds by Website Operator: The Operator cannot:
    • refund lost Bets or Wagers;
    • reinstate voided Bonuses; or
    • compensate you for delayed or failed withdrawals from Third-Party Operators.
  • Third-party policies: Any refund, reversal, or goodwill credit is solely within the discretion and legal obligations of the relevant Third-Party Operator, subject to its own terms, license conditions (e.g., under Curaçao law), and applicable consumer-protection or anti-money-laundering rules.

Limitation of Liability

To the fullest extent permitted by applicable law, including Australian Law, the Operator's liability to you in connection with your use of the Website and the Coin Poker Service is strictly limited as set out below.

Operator's Obligations

  • Information accuracy: The Operator endeavours to:
    • present Content that is based on genuine observations, research, and public information available at the time of writing, including references to technical protocols such as "Mental Poker" and academic work on crypto-gambling;
    • regularly review and update core Content, with a target review cycle extending through 2026; and
    • flag, where reasonably possible, when a Third-Party Operator is subject to enforcement actions or blocking orders, such as inclusion on ACMA's list of illegal offshore gambling websites.
  • No warranty of completeness: Despite these efforts, the Operator:
    • does not warrant that the Content is complete, up to date, or free from error; and
    • does not guarantee the legality, financial standing, or fairness of any Third-Party Operator, including those licensed in Curaçao under 1668/JAZ.

Exclusions of Liability

  • No liability for third parties: The Operator is not responsible for:
    • the acts or omissions of Third-Party Operators or payment providers;
    • any loss arising from your reliance on a Third-Party Operator's solvency, licensing, marketing statements, or on-chain data; or
    • enforcement or blocking actions by ACMA or other regulators that affect your access to offshore gambling sites.
  • Technical failures: Without limiting the above, the Operator is not liable for:
    • any interruption, delay, or unavailability of the Website;
    • network failures, distributed denial-of-service (DDoS) attacks, bugs, viruses, or malware that may affect your devices or connectivity; or
    • errors or inaccuracies in data feeds, price information, or links provided on the Website.
  • Regulatory changes: The Operator shall not be liable for any loss, including loss of access to accounts or funds with Third-Party Operators, arising from changes in law, regulatory policy, or enforcement practices (including changes to the IGA or ACMA blocking decisions) that occur after Content is published.

Maximum Compensation

  • Limitation cap: To the extent that the Operator is found liable to you in connection with the Website despite the exclusions above, the Operator's total aggregate liability (whether in contract, tort, negligence, statute, or otherwise) shall be limited to the greater of:
    • AUD 50; or
    • the amount, if any, actually paid by you (excluding Bets and Wagers with Third-Party Operators) directly to the Operator for chargeable Website services during the six (6) months preceding the event giving rise to the claim.
  • No liability for gambling losses: The Operator bears no liability for any gambling or wagering losses, lost profits, or loss of opportunity incurred with Third-Party Operators. For clarity, any reference in industry practice to "maximum compensation not exceeding the amount of the bet" does not apply here, as no bets are placed with the Operator.
  • Non-excludable rights: Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under Australian consumer law, to the extent such law applies to your use of the Website.

Intellectual Property Rights

All intellectual property rights in and to the Website and the Coin Poker project instance are owned by or licensed to the Operator and are protected by copyright, trademark, database, and other intellectual property laws and treaties.

Ownership of Content and Software

  • Content: Unless otherwise stated:
    • all text, reviews, analyses, layouts, graphics, logos, and images on the Website are the intellectual property of the Operator or its licensors;
    • any third-party trademarks, trade names, or logos (including "Coin Poker" and other brand names) are used solely for identification and review purposes and remain the property of their respective owners; and
    • no affiliation, sponsorship, or endorsement by those third parties is implied unless expressly stated.
  • Software: The code, scripts, and software components used to operate the Website (excluding any third-party open-source code used under their respective licenses) are proprietary to the Operator or its licensors.

Permitted Use and Prohibitions

  • Limited licence: The Operator grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Website and its Content for personal, non-commercial purposes only, in accordance with these Terms.
  • Prohibited actions: Without the prior written consent of the Operator, you must not:
    • copy, reproduce, modify, adapt, translate, or create derivative works from the Content;
    • distribute, transmit, display, sell, resell, or otherwise exploit any part of the Website or Content for commercial gain;
    • use automated tools (e.g., bots, scrapers, crawlers) to systematically access, collect, or index Content, except as permitted by applicable law and robots.txt;
    • remove, obscure, or alter any copyright, trademark, or other proprietary notices on the Website; or
    • reverse engineer, decompile, or disassemble any part of the Website software, except to the extent explicitly permitted by law.

Privacy & Data Protection

Your use of the Website and any personal data you provide to the Operator are governed by the Website's privacy policy, as amended from time to time.

  • Reference to privacy policy: All collection, use, storage, and disclosure of personal data (such as your email address when contacting [email protected] or subscribing to updates) is carried out in accordance with the Operator's privacy policy, which is incorporated by reference into these Terms.
  • Data processing: By using the Website, you acknowledge that:
    • your data may be processed in jurisdictions outside Australia, including in offshore locations where the Operator or its processors are located; and
    • appropriate technical and organisational security measures are intended to be applied, but absolute security cannot be guaranteed.
  • Cookies and tracking: The Website may use cookies and similar technologies for functional and analytical purposes. Details are set out in the privacy policy and/or cookie notice.

Changes to Terms

The Operator may modify or update these Terms from time to time, including to reflect changes in Australian Law, ACMA enforcement practices, Curaçao licensing conditions, or the Operator's business model.

Notification of Updates

  • Website notice: Material changes to these Terms will generally be notified by:
    • updating the "effective date" at the top of these Terms; and
    • displaying a banner, pop-up, or similar notice on the Website for a reasonable period after the change.
  • Email notification: Where feasible and appropriate (for example, if you have a registered Account and have not opted out of legal notices), the Operator may also notify you by email at the address associated with your Account.

Acceptance of Updated Terms

  • Continued use: Your continued access to or use of the Website after updated Terms have been posted constitutes your acceptance of the revised Terms.
  • Right to discontinue: If you do not agree to any updated Terms:
    • you must cease using the Website immediately; and
    • you may request closure of any Website Account you hold, subject to any residual obligations (e.g., relating to user-generated content you have posted).

Termination & Suspension

The Operator reserves the right to suspend or terminate your access to the Website and/or your Website Account in the circumstances described below, without prejudice to any other rights or remedies available to it under law.

Grounds for Suspension or Termination

  • Breach of Terms: The Operator may suspend or terminate your Account if it reasonably believes that you have:
    • materially breached these Terms or any applicable policy;
    • engaged in abusive, fraudulent, or illegal behaviour in connection with the Website; or
    • used the Website to promote or facilitate activity that contravenes Australian Law or other applicable laws (e.g., active promotion of services prohibited by the IGA).
  • Legal or regulatory requirements: The Operator may suspend or restrict access:
    • to comply with a legal obligation, regulatory directive, or court/administrative order in any relevant jurisdiction; or
    • where it is reasonably necessary to mitigate legal or compliance risks relating to Prohibited Jurisdictions, including Australia.
  • Security concerns: Immediate suspension may occur in cases of suspected:
    • compromise of your Account credentials;
    • bot use, scraping, or denial-of-service activities; or
    • other security incidents threatening the integrity of the Website.

Procedure and Effects of Termination

  • Notice: Where reasonably practicable, the Operator will:
    • provide you with notice of suspension or termination by email to your registered address; and
    • briefly state the reason for such action.
  • Account closure: Upon termination:
    • your access to Account-restricted features will cease;
    • data associated with your Account will be handled in accordance with the privacy policy; and
    • the Operator may, but is not obliged to, remove or anonymise user-generated content you have posted.
  • No impact on Third-Party Operator accounts: Termination of your Website Account does not directly affect any accounts you hold with Third-Party Operators. You must address any issues relating to those accounts directly with the relevant operator.
  • No refunds: As the Operator does not charge Users for gambling services nor hold Player funds, no refund of Bets, Wagers, or Bonuses arises in connection with termination of a Website Account.

Governing Law & Jurisdiction

The legal framework applicable to these Terms must account for the offshore nature of the Operator, the Curaçao licensing context, and the specific Australian Law considerations regarding access to offshore gambling services.

Applicable Law

  • Primary governing law: Subject to any mandatory provisions of local law that cannot be excluded, these Terms and any dispute arising out of or in connection with them shall be governed by and construed in accordance with the laws of Curaçao, without regard to its conflict-of-laws principles.
  • Australian mandatory law: If you access the Website from Australia:
    • certain provisions of Australian Law, including the IGA and applicable Australian consumer law, may apply to your use of the Website regardless of the governing law clause; and

    The Operator will endeavour to respond within a reasonable timeframe.
  • Arbitration / courts: Subject to any applicable mandatory law:
    • any dispute, controversy, or claim arising out of or relating to these Terms or the Website may, at the Operator's election, be finally resolved by arbitration seated in Curaçao or by the competent courts of Curaçao; and
    • you agree to the exclusive jurisdiction of such arbitral tribunal or courts in respect of any such dispute, except where mandatory law grants you the right to bring a claim in the courts of another jurisdiction.
  • No involvement in gambling disputes: The Operator is not a party to your gambling contract with any Third-Party Operator and cannot adjudicate or resolve disputes concerning:
    • bet settlement or game outcomes;
    • account closures or confiscations by Third-Party Operators; or
    • payment or non-payment of winnings.
    Such disputes must be raised directly with the relevant gambling operator and, where applicable, its licensing or regulatory authority.
